On December 7, Seesmo, citing Vaping360, reported that the Spanish government has recently issued a Draft Royal Decree proposing significant amendments to its current tobacco control laws. The public consultation period for this draft will conclude on December 13.
The draft aims to ban non-tobacco-flavored e-cigarette products and impose stringent restrictions on nicotine pouches. If the decree is passed, it could lead to the decline of the legal e-cigarette industry in Spain, potentially creating opportunities for black-market growth.
Key proposed regulations in the draft include:
Ban on Non-Tobacco Flavored E-cigarettes: All non-tobacco flavored e-cigarette products would be completely removed from the market.
Device Design Requirements: E-cigarettes must be designed to be shatterproof, leak-proof, and capable of delivering a stable nicotine dose.
Standardized Packaging and Capacity Limits: All e-liquids, including nicotine-free products, must be sold in small 10-milliliter bottles with simplified packaging.
Restrictions on Nicotine Pouches: Non-tobacco flavored nicotine pouches would be banned, and nicotine content per pouch would be capped at 0.99 milligrams, rendering them nearly incapable of satisfying consumer needs.
The proposed measures are expected to severely impact the e-cigarette industry, making it difficult for the legal market to survive.
