It is no secret that our enforcement colleagues lack capacity and capability to deal with the already significant ‘Black Market’ of illegal and untested vape products and this ban in my opinion is about to make matters far worse.
Trading Standards officers need far greater investment (they have seen cuts over the past 10 years that represent more than £200 million nationwide) than has been proposed and it is likely that in the short to medium term there will be a significant increase in black market products unless the UK can get a real grip on the import of illegal products.
In my experience we will now see a stage of ‘dumping’ of these products with manufacturers prepared to lose significant sums on the true cost of these products to recoup some of their losses. Consumers are lazy, they still want the simplicity of disposable products and as such the variety of illegal products pre and post the ban will not reduce but increase as a consequence.
In addition, we are likely to see a new range of products come into the market that meet the descriptors of the Environmental Protection Act in that they will not be defined as ‘single use’, these products will likely be of a low quality and no better in terms of environmental damage than ‘single use’ products. There is not to my knowledge anything that dictates the standards of rechargeable batteries or availability of replaceable pre filled pods, it does not take the brains of an arch bishop to work out what will happen next.
